These Terms of Service ("Terms") govern your access to and use of DMGO Technologies ("DMGO", "we", "us"), a SaaS platform available at dmgo.in. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use DMGO.

1. The Service
DMGO lets you connect your own Instagram professional account(s) and create automations that detect comments matching keywords you choose, reply to those comments, and send direct messages on your behalf and only on accounts you have authorized. DMGO also offers creator tools such as bio links and monetization pages for digital content, memberships, bookings, events, and seller-fulfilled physical products.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. You must own, or be authorized to manage, every Instagram account you connect to DMGO.
3. Your Account
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- You are responsible for the keywords, messages, links, and other content you configure in your automations.
4. Instagram & Meta Platform Compliance
- Your use of DMGO must comply with the Instagram Community Guidelines, the Meta Platform Terms, and all applicable Instagram policies.
- You must not use DMGO to send spam, unsolicited bulk messages, deceptive content, or anything that violates Instagram's rules. Automations should respond to genuine user interactions.
- You authorize DMGO to access your Instagram data and perform actions (replying to comments, sending DMs) solely to provide the features you enable.
- DMGO is an independent service and is not endorsed by, affiliated with, or sponsored by Meta or Instagram. Instagram may change or restrict its APIs at any time, which can affect availability.
5. Acceptable Use
You agree not to: (a) use the service for any unlawful, harmful, or abusive purpose; (b) attempt to disrupt, reverse-engineer, or gain unauthorized access to the service; (c) resell or misrepresent the service; or (d) violate the rights of any third party.
6. Subscriptions, Billing & Refunds
- Paid plans are billed through our payment provider (Razorpay) on the cycle shown at checkout (monthly or annual).
- Taxes: DMGO is a micro-enterprise currently below the GST registration threshold and therefore does not charge GST. The price shown at checkout is the total amount payable. If GST registration becomes applicable in future, taxes will be shown separately.
- If you enable auto-renew, your plan renews automatically at the end of each cycle using your saved payment method until you cancel. You can cancel auto-renew at any time from your billing settings.
- Plan limits (such as the number of connected accounts or active automations) apply as described on our pricing page.
- DMGO's own subscription is a digital SaaS service. Independent sellers may also offer digital or physical products through DMGO checkout pages. For physical products, the seller is responsible for product accuracy, stock, packing, shipping, delivery support, returns, and legally required seller disclosures; DMGO provides the hosting, checkout, payment, and recordkeeping tools described at checkout.
- Refunds: subscription fees are generally non-refundable. As a goodwill exception, you may request a refund within 3 days of a charge if a genuine automation or account-connection issue on our side prevented you from using the service and our team could not resolve it. - When you cancel, access continues until the end of the current billing period; we do not charge you again after that.
- Products you buy from independent creators through DMGO are covered by the separate Buyer Refund Policy.
7. Creator Earnings & Payouts
If you sell digital products, memberships, or other paid offerings to your own audience through DMGO, the following applies to the money you earn:
- Commission: DMGO deducts a platform commission from each sale based on your current plan (for example, lower commission on higher plans). The exact rate that applied is shown with each sale in your earnings dashboard.
- Payment processing fees: In addition to the DMGO commission, payment processing is handled by a third-party payment provider (Razorpay). Processing fees are applied as follows:
- One-time sales — DMGO deducts only its commission. The standard payment gateway (UPI) processing fee is absorbed by DMGO and is not passed on to you, so your net equals the sale price minus the DMGO commission.
- Recurring / auto-renewing sales (for example monthly or yearly memberships) — DMGO deducts its commission plus the payment provider's fixed per-cycle AutoPay fee. This fixed fee is charged by the provider on each renewal and varies by transaction amount band.
- Net payable: for each sale, your net payable is the sale price minus the DMGO commission and, where applicable, the processing fee described above. A live estimate of your net payable is shown before you publish a product, and the commission rate and amounts that applied are shown with each sale in your earnings dashboard.
- Hold window: your share of each sale is held for 7 days after the sale to cover refunds, chargebacks, and disputes. During this period the amount is shown as "held" / pending and is not yet payable.
- Payout: once the hold window passes and your payout details are verified, your earnings are released to your bank account. Bank verification (KYC) usually takes 1-2 business days, and once a payout is initiated it typically settles to your account within 3-4 business days, subject to bank and payment-provider timelines.
- Payouts are processed through our payment provider (Razorpay). DMGO does not store your full bank account number. You are responsible for the accuracy of the payout details and tax information you provide, and for any taxes due on your earnings.
- We may withhold or reverse a payout in cases of fraud, chargebacks, policy violations, or amounts paid in error.
These timelines are estimates that depend on banks and our payment provider; they are not guarantees of an exact date.
8. Intellectual Property
DMGO and its software, design, and branding are owned by us and protected by law. You retain ownership of your own content and Instagram data. You grant us a limited license to process that data only to operate the service.
9. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted operation, specific results, or that third-party platforms (including Instagram) will remain available or compatible.
Third-party platform actions: Meta and Instagram may restrict, suspend, or disable accounts, features, or API access at their sole discretion, at any time and without notice. DMGO operates exclusively through Meta's official APIs, enforces Meta's published rate limits and messaging windows, and never sends unsolicited messages — but no tool can guarantee immunity from platform enforcement. Any action Meta or Instagram takes against your account (including suspension, restriction, shadow-restriction, or permanent disabling) is a matter between you and Meta, and is typically driven by the content you configure, how recipients react to it (for example spam reports), or your activity outside DMGO. DMGO has no control over, and accepts no responsibility or liability for, such actions. On request, we will share your account's automation activity logs to help you appeal a platform decision.
10. Limitation of Liability
To the maximum extent permitted by law, DMGO shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the service — including any loss caused by an action a third-party platform (such as Meta or Instagram) takes against your accounts, such as suspension, restriction, or termination. Our total liability shall not exceed the amount you paid us in the three months before the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless DMGO, its proprietor, and its personnel from and against any claims, demands, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) the content, keywords, messages, links, or offers you configure or distribute through the service; (b) your violation of these Terms, the Instagram Community Guidelines, the Meta Platform Terms, or any applicable law; (c) your products, services, or dealings with your own customers and audience; or (d) any dispute between you and Meta or Instagram, including actions taken against your accounts.
12. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms or Instagram's policies, or to protect the service and its users.
13. Changes to These Terms
We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes shall be subject to the courts having jurisdiction in India.
15. Grievance Redressal
In accordance with applicable Indian law - including the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023 - complaints regarding the service or your data may be sent to our Grievance Officer:

We acknowledge complaints within 48 hours and aim to resolve them within 30 days. Data-related complaints may be escalated to the Data Protection Board of India.
